By creating an account, accessing the application architecture, or interacting with any AI-generated assets on Classmate, you agree to be bound by these Terms of Service. The document below outlines the rights, obligations, and operational parameters that govern your use of our educational platform.
Last updated: November 3, 2026
Acceptance of Terms
Welcome to Classmate. The Classmate website (www.yourclassmate.ai), the Classmate mobile application for Android (the "App") and their educational tools (collectively referred to as the "Platform", "Service", "we", "us", or "our") are operated by “NIKOLA SREĆKOV PR CLASSMATE”, a Solo Proprietorship registered in Serbia, Zmajevo, with Registration number 68757304, Tax ID 115931079 and D-U-N-S number 369951395, existing under the laws of Republic of Serbia. This Platform User Agreement ("Terms of Service", "Agreement") constitutes a binding, enforceable legal contract between the Operator and you ("User", "you", or "your"), governing your entire access to and operational utilization of the Classmate software ecosystem. By explicitly checking the acknowledgment box during registration, creating an authenticated account, accessing the application architecture, or interacting with any AI-generated assets, you unequivocally declare your full understanding of, and aggregate legal consent to be bound by, all provisions contained herein. If you do not accept these terms in their entirety, you are strictly prohibited from utilizing the Service. Your continued use of the Platform implies definitive acceptance of all parameters laid out in this binding framework.
Overview of Service & Internal Architecture
Classmate delivers an automated, artificial-intelligence-driven learning assistant designed for students aged 13 and older, from the upper grades of elementary school through high school and college. The platform parses user-uploaded textbooks, homework assignments, and structural notes to synthesize individualized study aids. The operational components of the platform include, but are not limited to:
- Custom Quiz Generation: Algorithmic synthesis of automated test questions, including multi-tier answer choice validations, error explanations, and localized topic tagging.
- Interactive Study Schedules: Rolling 3-day adaptive study frameworks that utilize algorithmic behavioral metrics to dynamically scale tasks based on user performance variances.
- Digital Memory Aids: Machine-generated comprehensive rich-text summaries and graphic mind maps powered by interactive front-end frameworks.
- Ask-Classmate Tutor: A natural-language query interface enabling users to engage with an automated academic assistant for in-lecture content analysis.
The technical execution of these capabilities relies heavily on third-party cloud infrastructure and Large Language Model (LLM) providers. You acknowledge and accept that the nature of the software requires asynchronous data transmission to cloud architectures to fulfill computational requests.
Account Security & Third-Party Authentication
Account provisioning, credential processing, multi-factor setting configuration, active session tracking, and user login authorization are outsourced entirely to our independent identity provider, Clerk (Clerk Inc., USA).
By registering an account via email or third-party OAuth channels (Google or Apple sign-in), you recognize that Classmate completely bypasses internal processing or direct ingestion of plain-text or hashed passwords. All authentication states are handled by Clerk via JSON Web Tokens (JWT). You maintain exclusive legal liability for safeguarding your login identifiers and session persistence tokens. You must immediately notify our administration at legal@yourclassmate.ai regarding any unauthorized security breach or credentials compromise.
Age Eligibility & Mandatory Legal Guardian Consent
Classmate is strictly intended for students aged 13 and older, including students in the upper grades of elementary school (for example, grades 7 and 8), high school and college. To form a valid agreement under the European Union General Data Protection Regulation (GDPR) and regional statutes, the minimum age thresholds are governed by strict criteria:
- The platform enforces a baseline age minimum of 13 years old. No accounts may be established by individuals below this age under any circumstances.
- In absolute alignment with GDPR Article 8 and Balkan data protection acts, users who have passed the baseline of 13 years old but remain beneath the legal age of digital consent established within their specific EU Member State or country of residence (which oscillates between 13 and 16 years of age) must possess verified parental, legal guardian, or institutional consent prior to creating a profile.
The Operator reserves the right to employ automated diagnostic parameters, documentation requests, or electronic validations to ensure age declarations are truthful. If we discover the unauthorized collection of data from a minor under the digital age of consent without legal guardian authorization, we will activate backend deletion workflows to permanently wipe out the corresponding data rows.
User Uploads, Acceptable Use & Content Restrictions
Ownership of Materials: You retain undivided intellectual property rights and full legal ownership over all original textbooks, personal handwritten notes, documents, PDFs, and image layers (JPEG, PNG formats) that you transmit to the platform ("Uploaded Content"). No provision within this contract transfers your underlying copyright or intellectual property rights to the Operator.
Limited Operational License: To provide the core functionalities of the application, you hereby grant Classmate a non-exclusive, worldwide, royalty-free, non-transferable, localized license to host, parse, copy, index, programmatically extract text from, and transmit your Uploaded Content. This license is granted strictly to facilitate automated AI analysis, generate localized study plans, construct quizzes, and render individual lectures within your account interface. This license terminates instantly from our production databases upon the destruction of the file or full deletion of the user account.
Technical and Format Constraints: You may only upload supported document formats (PDFs) and image formats (JPEG, PNG). Uploading standalone video sequences or standalone pre-recorded audio materials is technically blocked and contractually prohibited. The sole exception is real-time, volatile voice interaction executed via live audio preview modules (available on the website only), which streaming infrastructure processes directly without persistent server storage.
Prohibited Content and Intellectual Property Protection: You are strictly prohibited from utilizing the Platform to process unlawfully obtained copyright materials, unauthorized copies of institutional textbooks, or files that violate the academic integrity guidelines of your specific high school, school board, or country. The Operator does not pre-screen uploads, but reserves the right to strip out infringing materials immediately upon receiving a valid intellectual property complaint.
Acceptable Use: You may not use the Service to generate, request or share content that is illegal, sexually explicit, hateful, harassing or violent, or that promotes self-harm; to bypass usage limits, scrape, reverse engineer or overload the Service; to share your account with others; or in any other way that violates the law or the rights of others.
Reporting Generated Content: Content generated by the Service is created automatically and may occasionally be inaccurate, inappropriate or offensive. You can report any generated content using the report option in the App or on the website, or by emailing legal@yourclassmate.ai. We review every report and remove or correct content where appropriate.
Suspension and Termination by the Operator: We may suspend or terminate your account, with prior notice where reasonably possible, if you seriously or repeatedly breach these Terms, misuse the Service, or put other users or the Service at risk. If your account is terminated for a breach, Section 8 (Refund Policy) applies.
Large Language Models & Intelligent Capability Limitations
By utilizing the platform, you acknowledge that all query inputs, textbook extractions, onboarding criteria, and user performance indexes are structurally analyzed via third-party Large Language Models provided by Anthropic (Claude models, operated by Anthropic, PBC, USA), with short text excerpts converted into search embeddings by Voyage AI. You are interacting with an artificial intelligence system, not a human: summaries, quizzes, explanations, study plans and messages are generated automatically and may be inaccurate or incomplete, so verify important information against your course materials. The legal and functional parameters governing this automated interaction are defined as follows:
- Volatile Processing Window: Content sent to Anthropic is not used to train its models and is automatically deleted by Anthropic within 30 days, except content its automated safety systems flag as violating its usage policy, which it may keep for up to 2 years.
- Identity Masking: Classmate never sends your email address, last name, or account identifiers to AI providers. The only identity detail included is your first name, so that greetings and study plan tasks can address you personally.
Session Replays: Only if you consent to analytics, Classmate uses PostHog to record session replays, a visual rendering of how you interact with the website or the App (clicks, taps, page and screen transitions and button inputs). All input fields are masked, and in the App all text and images are hidden in these recordings. You can withdraw your consent at any time in the settings of the website or the App.
Payment Infrastructure & Merchant of Record (Lemon Squeezy & Google Play Billing)
Premium tiers, adaptive analytical extensions, and subscription packages are managed through independent third-party payment infrastructure partners. Depending on the platform utilized to initiate a transaction, payments are processed under the following parameters:
Web Transactions (Lemon Squeezy): All web-based payment processing, monetary transactions, tax calculations, invoicing, and regional payment compliance are processed exclusively by Lemon Squeezy (Lemon Squeezy, LLC), acting as the official Merchant of Record for Classmate. By starting a premium web checkout, you establish a direct contractual relationship with Lemon Squeezy, binding yourself to their terms of service and billing policies. Any refund claims, web subscription cancellations, or payment errors must be coordinated through Lemon Squeezy's customer portal or support.
In-App Purchases (Google Play Billing): All Android application transactions, mobile subscriptions, and digital tier upgrades are processed exclusively via the Google Play Billing API, operated by Google LLC. By initializing an in-app checkout sequence within the Android application, you establish a direct contractual relationship with Google, binding yourself to the Google Play Terms of Service and standard developer billing policies. Any mobile refund claims, in-app subscription cancellations, or payment errors must be managed through your Google Play account interface.
In-App Purchases (Apple App Store): All iOS application transactions, mobile subscriptions, and digital tier upgrades are processed exclusively through Apple's In-App Purchase system and billed to your Apple ID by Apple Inc. By purchasing within the iOS application, you also agree to the Apple Media Services Terms and Conditions. Any mobile refund claims, in-app subscription cancellations, or payment errors must be managed through your Apple ID account; Classmate cannot cancel or refund App Store subscriptions on your behalf.
Apple App Store Terms: If you downloaded the App from the Apple App Store, these Terms are concluded between you and Classmate only, not with Apple, and Classmate, not Apple, is solely responsible for the App and its content. Apple has no obligation to provide any maintenance or support services for the App. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession and use of it, including product liability claims, claims that the App fails to conform to any legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation, nor for the investigation, defence, settlement, or discharge of any third-party claim that the App or your possession and use of it infringes that third party's intellectual property rights. You represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
Classmate never processes, views, or records your financial account numbers, credit card data, or banking hashes across either payment channel.
Subscriptions, Automatic Renewal and Free Trials: Premium subscriptions renew automatically at the end of each billing period at the price shown at the time of purchase, unless you cancel before the renewal date. If a subscription starts with a free trial, you will be charged when the trial ends unless you cancel before then. Subscriptions bought in the Android App are managed and cancelled in Google Play (Payments & subscriptions); subscriptions bought in the iOS App are billed to your Apple ID and managed and cancelled in your Apple ID subscription settings (Settings, then your name, then Subscriptions) at least 24 hours before the end of the current period; subscriptions bought on the website are managed and cancelled through Lemon Squeezy's customer portal (Manage subscription on the Pricing page). Cancelling stops future renewals, and you keep premium access until the end of the period you have already paid for.
Refund Policy
All purchases, premium subscription fees, and digital tier upgrades are subject to the refund governance dictated by the payment channel used to execute the transaction:
- Web Transactions (Lemon Squeezy): As Lemon Squeezy serves as the official Merchant of Record for web transactions, all web-based refund requests are subject to Lemon Squeezy's buyer terms and applicable European Union, EEA, and regional statutory withdrawal rights. Users may request a refund within 14 days of purchase, provided the premium service has not been fully consumed or exploited. Refund requests must be submitted through Lemon Squeezy’s customer support or by contacting legal@yourclassmate.ai
- In-App Purchases (Google Play Billing): Mobile transactions executed via the Google Play Billing are governed directly by Google Play refund policies. Users may request a refund for recent purchases directly through their Google Play Account order history within Google's standard submission window (typically 48 hours from transaction). Subsequent refund requests outside this window are subject to the Operator's discretion and local consumer protection laws.
- In-App Purchases (Apple App Store): Purchases made in the iOS App are billed by Apple and governed by Apple's refund policies. Refund requests are submitted directly to Apple at https://reportaproblem.apple.com. Classmate cannot issue refunds for App Store purchases.
Non-Refundable Conditions: Refunds will not be granted for partial subscription cycles, unused portions of active billing periods, or instances where an account has been suspended or terminated due to a violation of Section 5 (User Upload Permissions & Strict Content Restrictions) or academic integrity standards.
Telemetry Monitoring & Analytical Exclusions
To safeguard application stability and map user interactions, the platform incorporates advanced event-tracking utilities. These systems operate within strict operational parameters to ensure user privacy:
- PostHog Tracking: User movement parameters, feature activation states, and user-masked visual session replays are handled by PostHog Inc. This telemetry is disabled by default and runs only if you give affirmative consent via the consent banner on the website or the consent prompt in the App. You can withdraw your consent at any time in the settings of the website or the App. All interface input forms are automatically masked, and in the App all text and images are hidden in recordings.
- Sentry Crash Logging: Runtime errors, application bottlenecks, and system bugs are dispatched to an isolated Sentry endpoint located inside the European Union.
- Prohibited Telemetry Activities: The platform does not track your cursor coordinates outside app layouts, scroll depths, typing rhythms, or multi-site tracking cookies. No data is shared with third-party behavioral advertising brokers.
Account Termination & Cascade Cleanups
Right to Cease Service: You possess the right to close your user account at any moment. You can delete your account in the App (Settings, then Delete account), on the website in your account settings, or by emailing legal@yourclassmate.ai.
The Database CASCADE Effect: When an account deletion event is successfully initiated, the primary database triggers a hard delete via a CASCADE configuration. This command permanently wipes all related entries across database tables, including onboarding questions, notes, generated quizzes, metrics, and streaks. Deleting your account also deletes your sign-in account held by Clerk and your analytics data held by PostHog, and cancels any active subscription so that it does not renew.
Emergency Infrastructure Backups: To protect the database from data corruption, data snapshots are saved in secure, encrypted backups. When you delete your account, it is wiped from active servers immediately, but data remains in encrypted backups for between 30 and 90 days before being completely overwritten.
Comprehensive Limitation of Liability
To the absolute maximum extent permitted under applicable law within European Union Member States, Balkan regional jurisdictions and worldwide legal systems, Classmate, its founders, operators and employees shall not be held liable for any indirect, incidental, special, consequential or punitive damages. This limitation encompasses, without restriction, loss of academic standing, school disciplinary actions, grade variances, examination failures, loss of personal data, system downtime, hardware errors, or financial losses arising out of your utilization of, or technical inability to access, the Service, even if our team has been explicitly advised of the potential for such operational damages.
The Service and all generated material are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. Classmate entirely disclaims the implied warranties of merchantability, fitness for a particular educational objective and non-infringement. We do not warrant that the AI-generated extractions, quizzes or feedback generated by Large Language Models will be completely accurate, error-free or uninterrupted. Automated Large Language Models occasionally replicate fictional scientific or historical statement entries ("hallucinations"). The User accepts the absolute obligation to verify critical academic facts independently against verified textbooks or institutional curriculums.
In no event shall the aggregate financial liability of Classmate for all claims, lawsuits or judgments exceed the greater of: (A) the total fees actually paid by you to Classmate via Lemon Squeezy or Google Play during the six month period immediately preceding the accrual of the liability, or (B) fifty euros (50.00 EUR). The existence of multiple claims shall not enlarge this limit.
Amendments and Evolution of the Service
Evolution of Terms: We reserve the right to amend, update, or restructure these Terms of Service at any time to reflect software upgrades, server migrations, or regulatory changes. Significant updates will be communicated via the platform interface or through your registered email. Continued interaction with Classmate following modifications signifies your legally binding acceptance of the updated Terms of Service.
Governing Law and Jurisdiction
This Agreement shall be governed by, and interpreted in accordance with, the laws of the country of registration of the Operator (Republic of Serbia), without reference to conflict of law principles. Any dispute arising under this contract shall be submitted to the exclusive jurisdiction of the competent courts in the Operator's registered seat. If you are a consumer, this does not deprive you of the protection of the mandatory provisions of the law of your country of residence, or of your right to bring proceedings in the courts of that country.
